Judge Royce Lamberth of the U.S. district court in Washington D.C. today became the second federal judge to order discovery regarding Clinton emails. Both cases were brought by the invaluable Judicial Watch.Another step closer to the Frog March!
As we have discussed, Judge Emmet Sullivan, a Clinton appointee, has already granted Judicial Watch discovery on the Clinton email matter in separate litigation. Judicial Watch’s discovery plan in that case seeks the testimony of eight current and former State Department officials, including top State Department official Patrick Kennedy, former State IT employee Bryan Pagliano, and Clinton’s two top aides at the State Department: Cheryl Mills and Huma Abedin.
The discovery ordered by Judge Lamberth pertains to emails surrounding the infamous Benghazi talking points — the Obama administration’s attempt to hide the fact that the Benghazi attacks were the premeditated effort of a group connected with al Qaeda.

Watchdog group Judicial Watch has been trying to squeeze Hillary Clinton’s documents out of the State Department with Freedom of Information Act requests for years. FOIA requests have a way of turning into FOIA lawsuits before any wing of the Obama Administration responds to them.I'm sure the find was unexpected!
Last Friday, three years after one such suit was filed, the State Department suddenly discovered thousands of previously undisclosed Clinton documents.
“This latest find of Clinton records, at this late date, is astonishing,” Judicial Watch president Tom Fitton declared. “The State Department waited to last possible moment, as it did with the Clinton emails, to tell Judicial Watch and the federal courts about thousands of records that haven’t been searched, as the law requires. Who knew what – and when did they know it – about these new Clinton documents?”

The Clintons are street fighters, and over their scandal-plagued years they have mastered outwitting the press, Congress, the Justice Department, even special prosecutors. But the reason Mrs. Clinton isn’t winning her latest scandal is because she faces a new opponent—one she can’t beat: the Freedom of Information Act.
Of all the Clinton email revelations this week, none compared with a filing by the State Department in federal Judge Emmet Sullivan’s court in Washington on Monday. The filing was a response to a FOIA lawsuit brought in March by conservative organization Citizens United. The group demanded documents from Mrs. Clinton’s tenure as secretary of state related to the Clinton Foundation and to the 2012 terrorist attack on the U.S. diplomatic outpost in Benghazi, Libya. What the State Department revealed was a testament to the power of FOIA.

Judge Grows Irritated with State Department Foot-Dragging on Clinton E-mails

The federal judge presiding over Judicial Watch’s FOIA lawsuit seeking Hillary Clinton’s emails while Secretary of Stat has denied DOJ’s motion to delay a hearing to explain DOJ’s obstinance:But does the Judge have big enough stones to jail someone from the Administration for contempt?President Obama’s administration asked a federal judge for a one-week delay of a hearing convened to discuss why the State Department hasn’t been more forthcoming about Hillary Clinton’s e-mails. The motion was denied, but the judge moved the hearing back an extra hour, making clear that the move was his prerogative and not State’s. “Due to the Court’s calendar, the status hearing will take place at 1:00 p.m. on August 20, 2014 in Courtroom 24A, rather than 12:00 p.m. as originally scheduled,” U.S. District Judge Emmet G. Sullivan, a Bill Clinton appointee, wrote Tuesday afternoon. . . .It’s not just foot-dragging. It’s obstruction of justice, providing Clinton with plenty of time to play hide-and-scrub. The Administration has been wildly successful at avoiding Congress’s investigations like the plague but is finally being held accountable by the courts. Congress is ineffectual and afraid of its own shadow. Federal judges, not so much; they don’t take kindly to being ignored or played.
“The Department does not believe that a reasonable search for records responsive to plaintiff’s FOIA request requires a search of former Secretary Clinton’s server,” administration officials wrote in a status report to the judge.
The State Department also demurred when ordered to find out if there were other servers that might hold work-related records created by Clinton or two of her top aides, saying they were “not currently aware of any personal computing devices issued by the Department to former Secretary Clinton, Ms. Abedin, or Ms. Mills that may contain responsive records.”
That wasn’t good enough for Judicial Watch or, apparently, Judge Sullivan. “Taking this sworn statement on its face, it appears as though the declarant made no effort whatsoever to find out what electronic devices the former head of the agency and two of her closest advisors used to conduct official government business for four years and where these electronic devices may be located or if they are still in existence,” the group wrote in its request for the new hearing.

Federal Judge Reopens Suit to Obtain Huma Abedin’s Clinton E-Mails

A federal judge has reopened a Freedom of Information Act lawsuit that aims to obtain e-mails between former Secretary of State Hillary Clinton and her longtime aide, Huma Abedin, saying that the discovery of Clinton’s private server warranted the revival of the case.Good!!
Judicial Watch, a nonprofit watchdog group, asked the judge to find that Clinton had committed fraud, but he demurred, choosing instead to rely on a rule that allowed for the case to be reopened due to a change in circumstances. The State Department agreed that this rule applied. “The Court will rely upon that provision, rather than spilling ink to resolve their dispute as to whether Judicial Watch has submitted clear and convincing evidence of fraud by the State Department,” Judge Emmet Sullivan wrote in his order today.
